Lawyers' Fund for Client Protection Urges New Jersey Clients to Submit Claims Before Fourth Quarter Deadlines - Up to $1.5 Million in Claims Against Dishonest Attorneys Available.

The New Jersey Lawyers' Fund for Client Protection has announced that the deadline for submitting claims for the fourth quarter is fast approaching. Michael T. McCormick, the director of the fund, has urged anyone who wishes to file a claim against an attorney to do so before the deadline, and has outlined the conditions that must be met for a claim to be eligible.

The purpose of the fund is to pay on behalf of the honest majority of lawyers for the wrongdoing of a few. To be eligible for compensation, the attorney against whom a claim is filed must have been a member of the bar, or acting as either attorney or fiduciary, at the time of the incident. They must also have been disbarred, suspended, or placed on disability inactive status from the bar, or convicted of embezzlement or other misappropriation of property. The attorney's conduct giving rise to the claim must have been dishonest rather than negligent.

If an attorney is disbarred or suspended, the fund has jurisdiction to receive claims against that attorney for a period of one year after the discipline is issued. A client's claim does not need to be included in the ethics determination to be compensable, and discipline of the attorney does not guarantee compensability for any specific claim.

Individual clients can receive up to $400,000 in compensation, while the fund can provide up to $1.5 million in claims against a lawyer. Claim forms are available by contacting the New Jersey Lawyers' Fund for Client Protection, and claimants who are assisted by practicing attorneys receive their representation free of charge.
