US Attorney’s Office in New Jersey Implements New Policy for Corporate Self-Disclosure of Misconduct
The U.S. Attorney's Office for the District of New Jersey has adopted a new voluntary self-disclosure policy that incentivizes companies to report misconduct and cooperate with the government in corporate criminal investigations. Under the policy, a company that discloses all relevant facts about employee or agent misconduct to a USAO in a timely fashion will receive benefits including a reduction in criminal penalty and no guilty plea. However, aggravating factors such as threats to national security or deeply pervasive misconduct may still warrant a guilty plea. The policy was developed in response to a DOJ memo and aims to standardize VSD policies nationwide.
