Man Sentenced to 23 Years in Prison for Aggravated Sexual Assault and Burglary

Brian K. Session, formerly of Jersey City, handed lengthy prison term for multiple offenses

MORRISTOWN, NJ - Morris County Prosecutor Robert J. Carroll, First Assistant Prosecutor Maggie Calderwood, Chief of Detectives Robert McNally, and Morristown Police Chief Darnell Richardson have announced the sentencing of Brian K. Session, 53, for multiple counts of Aggravated Sexual Assault and Burglary committed in Morristown between 2017 and 2018.

The Honorable Judge Ralph E. Amirata, J.S.C., handed down Session's sentence on July 6, 2023, totaling 23 years of incarceration in New Jersey State Prison. Specifically, Session received an 18-year sentence for a first-degree Aggravated Sexual Assault offense, subject to the No Early Release Act, Parole Supervision for Life, and Megan’s Law. Additionally, he was given a consecutive 5-year sentence for five counts of Burglary, with 2.5 years of parole ineligibility.

Despite numerous delays due to Session’s requests for adjournments and the COVID-19 trial shutdown, the case was scheduled for trial in September 2022. Facing a 30-count indictment, Session pled guilty on September 29, 2022. During his plea, Session admitted to breaking into five separate apartments to commit theft and confessed to sexually assaulting a victim during a burglary on January 18, 2018.

Session later filed a motion to withdraw his guilty plea on March 9, 2023, claiming ineffective assistance of counsel and insufficient time to review evidence. Judge Amirata denied this motion on July 6, concluding that Session’s arguments “defied credibility” based on the evidence and that justice would not be served by granting his motion.

The prosecution team, including Chief Assistant Prosecutor Meg Rodriguez and Assistant Prosecutor Samantha Polizzi, has received recognition from Prosecutor Carroll for their efforts in this case. The Morristown Police Department, specifically Detectives Scott Weaver and Robert Edwards, and the Morris County Prosecutor’s Office’s Sex Crimes/Child Endangerment Unit and General Investigations Unit were also commended for their contributions to the investigation and prosecution.
