Morristown, NJ - In a move that underscores the balance between ensuring justice for clients and protecting the reputation of the majority of lawyers, the Lawyers’ Fund for Client Protection has made a public announcement regarding upcoming deadlines for claims. Michael T. McCormick, director of the fund, stressed the importance of adhering to the provided deadlines, particularly for those intending to file against the attorneys enumerated in the notice.
Established as a means to stand up on behalf of the ethical majority of lawyers, the fund's aim is to rectify the misdeeds of a small fraction who stray from the path of integrity. For a claim to qualify, the targeted attorney must have been actively practicing at the time of the incident in question. This attorney must have faced disciplinary actions such as suspension, disbarment, or a similar punitive measure or been found guilty of crimes like embezzlement or property misappropriation. It’s pertinent to note that the wrongdoing must stem from dishonesty rather than mere negligence.
The triggering event for the fund's jurisdiction is the Supreme Court's decision to either suspend or disbar an attorney. From this point, clients are granted a one-year window to file their claims. However, it's worth noting that an ethics determination isn't a necessary precursor for compensation. An attorney's disciplinary actions don't serve as a guarantee for claim validation, as other factors beyond misappropriation may lead to their censure.
Clients are entitled to seek compensation up to $400,000, while the fund can shoulder claims against an attorney to the tune of $1.5 million.
