Morris Plains Man Receives 7-Year Sentence for Role in Fatal Overdose

In a pivotal case, Anthony Dello-Russo is sentenced under NJ's strict drug-induced death liability law following a fatal incident in Whippany.

MORRISTOWN, NJ – Morris County authorities have concluded a significant legal proceeding against Anthony Dello-Russo, 28, from Morris Plains, who has been sentenced to seven years in state prison after pleading guilty to charges linked to a fatal drug overdose. This sentence, handed down by Superior Court Judge Ralph Amirata on July 26, includes strict terms under New Jersey's No Early Release Act.

The case stems from a tragic event on February 16, 2023, when Hanover Township Police discovered 28-year-old T.H. deceased in Whippany due to an overdose involving cocaine, fentanyl, and acetyl fentanyl, as confirmed by the Morris County Medical Examiner. Following a detailed investigation, it was revealed that Dello-Russo had supplied T.H. with these lethal substances the day before the incident.

In a hearing on June 5, 2024, Dello-Russo admitted to his involvement, pleading guilty to first-degree strict liability for drug-induced death and second-degree possession of cocaine with intent to distribute. Beyond the prison term, Dello-Russo will forfeit over $50,000 seized during his arrest.

Prosecutor Carroll said,Morris County law enforcement agencies are committed to investigating and enforcing state law, and when appropriate, holding distributors of these deadly narcotics accountable. Drug dealers who operate in Morris County, take note - you are taking a huge risk with every dose of heroin/fentanyl you sell.

This case highlights the severe consequences of distributing controlled substances under N.J.S. 2C:35-9, where the provision of drugs resulting in death can lead to significant legal penalties. The investigation saw collaboration from multiple law enforcement bodies, including the Hanover Township Police, the Morris County Sheriff's Office Crime Scene Investigation Unit, and the Major Crimes and Special Operations Divisions of the Morris County Prosecutor's Office.

This sentencing serves as a stark reminder of the lethal risks associated with drug trafficking and the stern response from New Jersey's legal system in addressing such crimes.
