WHAT IS REQUIRED WITH THE NEW LEAD SAFE CERTIFICATION IF YOU ARE A PROPERTY OWNER?
In accordance with New Jersey P.L. 2021, Chapter 182, New Jersey DCA is now requiring all residential rental dwellings to be inspected for lead-based paint. This law aims to protect tenants, particularly children, from the dangers of lead exposure in residential housing. Please note, this law is currently in effect.
Under this legislation:
- All single-family, two-family, and multi-family rental properties constructed prior to 1978 must be inspected for lead-based paint hazards.
- Property owners must retain certified lead evaluation contractors to perform either a visual inspection or dust wipe sampling
- You must obtain a Lead Safe Certification or Lead-Free Certification to rent a pre-1978 property.
Lead-SAFE Certification is issued where, upon inspection, a lead paint hazard(s) is/are found on the property by a local agency or state-certified professional but is safely treated and requires no further action at the time of inspection or occupancy turn-over. This certification type is only good for two years and will expire.
Lead-FREE Certification is issued where, upon inspection, no lead paint is found anywhere on the property by a state-certified professional. This type of certification is good for the life of the property and does not expire unless a lead-based paint illness is reported to the State.
To assist property owners, the Borough has partnered with All Lead NJ via Resolution R154-2025 to facilitate these inspections. All Lead NJ will conduct inspections and provide the necessary certification of compliance.
