Concrete Contractor in Union Cited for Workers' Rights Violations at Princeton Job Site
NJDOL halts operations by BMC Concrete Foundations for misclassification and sick leave violations affecting 12 workers
The New Jersey Department of Labor and Workforce Development (NJDOL) has issued a stop-work order to BMC Concrete Foundations LLC, a Union-based subcontractor, for multiple workers' rights violations at a construction site in Princeton, the agency announced.
The stop-work order was served on May 28, 2025, at 11 Charlton Street, where BMC was performing foundation and concrete work as part of a project managed by primary contractor C & S Foundation Inc. of Waretown, N.J. The order was issued by NJDOL’s Division of Wage and Hour Compliance after an investigation uncovered numerous labor violations impacting 12 workers.
The violations included:

Failure to maintain proper records, including daily and weekly hours worked

Failure to pay or offer earned sick leave, as required by New Jersey labor laws

Failure to post required notifications regarding sick leave rights

Improper classification of construction workers, including misclassifying employees as independent contractors
The stop-work order remains in effect until BMC Concrete Foundations resolves all outstanding issues, including the payment of any back wages and penalties. NJDOL may impose civil penalties of $5,000 per day on any employer continuing operations in defiance of such an order.
This enforcement action is part of NJDOL’s broader initiative to protect workers from wage theft and misclassification, particularly in the construction sector. Since gaining expanded authority in July 2019, NJDOL has issued 191 stop-work orders statewide.
Employers are entitled to appeal a stop-work order, which would prompt NJDOL to schedule a hearing within seven days. The department also continues to monitor sites where violations have occurred to ensure compliance with state labor laws.
