The New Jersey Lawyers’ Fund for Client Protection has announced third-quarter deadlines for individuals seeking reimbursement due to dishonest conduct by former attorneys. The Fund, which provides financial relief to clients harmed by a small number of unethical practitioners, has set filing deadlines for claims against 13 attorneys whose professional misconduct triggered disciplinary action.
Who May File a Claim
To qualify for compensation, the claimant must demonstrate that the attorney acted dishonestly—such as misappropriating funds—rather than merely negligently. Additionally, the attorney must have been disbarred, suspended, placed on disability inactive status, or convicted of a relevant offense at the time of the incident. Claims must be filed within one year of the attorney’s formal discipline, unless a reasonable delay is justified.
The Fund’s jurisdiction is activated once the Supreme Court of New Jersey issues a final disciplinary ruling. However, clients can still file claims even if their individual case was not addressed in the disciplinary proceedings.
Compensation limits include up to $400,000 per individual claimant and a total of $1.5 million per attorney, depending on the losses and evidence submitted.
